Terms and conditions of use

Please read these terms and conditions before ordering from us. If you(the 'Customer') don't agree to the terms and conditions, please do not order from us.

Monsterthreads(the 'Company') is a trading name of Mamrot Holdings Pty Ltd atf SCT Apparel.

Your Status

By Placing an order through our site you warrant that you are:

  1. 18 years of age or older.

  2. Legally capable of entering into binding contracts

  3. In a country that we service.

Forming a contract with us


1. After placing your order with us, you will receive an e-mail from Monsterthreads acknowledging that we have received your order. This does not mean that your order has been accepted, but constitutes an offer to us to buy a Product. All orders are subject to availability and acceptance by us, and We will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the "Dispatch Confirmation"). The contract between us will only be formed when We send you the Dispatch Confirmation.

2. We will not process your order until payment has been received in full.

3. If you make a mistake with your order, you may be able to correct any mistakes made by email prior to your order being processed. If your order has already been processed you will be unable to amend your order. If your order has already been dispatched, you may be able to return the Products to us in accordance with our Returns Policy.

4. The Contract will relate only to those Products whose dispatch We have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.

5. We are entitled to refuse any order made by you for any reason, within the limits of the law.

  1. When making a request you undertake that all details you provide to us requesting goods or services are true and accurate, that you are an authorised user of the credit or debit card used to make your request and that there are sufficient funds to cover the cost of the goods and services. It is your responsibility to inform us of any changes to these details as soon as possible.

Indemnity:


You agree to indemnify, defend and hold harmless the Company, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your use of the Website, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.

Returns and Exchanges

Items may be exchanged within 21 days of the receipt of the goods. The buyer will be responsible for postage of the products to the Monsterthreads warehouse, together with a self addressed prepaid bag or envelope.

Monsterthreads will not be held responsible for the non delivery, loss in transit or late delivery of any return items.

Items can also be exchanged at monsterthreads stores. Please supply a proof of purchase.

Items must be returned in their original packaging and condition. We will not accept returns for items that are stained, washed, scrunched up, wrinkled or otherwise look like they are not new and in their original condition.

Monsterthreads does not provide refunds for change of mind.

Postage and Handling fees

Postage and handling fees are charged at flat rates on a tiered system. Usually the p&h is subsidised by Monsterthreads, however occasionally the actual postage fee will be less than the p&h fee charged to the customer. In this case the customer will not be entitled to any refund of the difference.

Delivery

Monsterthreads will post items within 3 business days of receiving your order. Most items are posted within one business day.


Most parcels are sent by Australia post or one of the large courier companies. Monsterthreads will not guarantee delivery times, and the customer will not hold Monsterthreads liable in event of late delivery to the extent permitted by the law.

The customer accepts that the courier or postman may leave a card if they can't reach the customer on delivery day. The customer may then need to pick the item up from their local post-office, or call the courier to arrange a redelivery.

Once the item passes on to the customer, all liability for the product passes on to the customer to the extent allowed by the law.

The customers will take care opening the product – Monsterthreads will not accept any liability for products damaged while opening, including but not limited to products damaged by opening with a sharp implement.

Prices and payments:

The price payable for the Products shall be as shown on the Website. Prices advertised on the Website include Australian GST but excludes delivery charges. Delivery charges are shown separately when ordering and must also be paid in advance. .

Payment shall be made by you by the means specified on the Website and shall not be deemed to be made until We have received cleared funds in respect of the full amount stated in the order.

Prices are subject to change without notice but changes will not affect orders which We have already accepted.

Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our site may be incorrectly priced. If the price is too high, we will refund you the different if payment has already been made. If the incorrect price is lower, we are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a miss-pricing

Monsterthreads reserves the right to have differences in prices for individual items between it's various physical locations and it's online store. The Customer will not be entitled to a refund for any noted price differences.

Payment for products can be by credit card, paypal or direct deposit.

For direct deposit orders, the customer accepts that the order will not be processed until after the funds are seen entering our bank account. The customer can provide a deposit receipt to speed up the process, but the receipt of the deposit receipt does not mark that Monsterthreads has received payment.

Only one promotion code can be used per order.


Faulty products:

Monsterthreads warrants that:

1. The Product will be delivered undamaged

2. The Product will be delivered in the quantities ordered; and

3. The Product will conform with the manufacturer's latest published instructions as set out on the Site or in our Product material at the time of your Order.


The Product is intended to be used strictly in accordance with the manufacturer's latest published instructions as set out on the Site or as on the Product itself. It is your responsibility to ensure that you use the Product strictly in accordance with those instructions.


Before delivery, we may make minor adjustments to material, colour, weight, measurements, design and other features to the extent that they are reasonable.

We try very hard to deliver Products in good condition, however, if you tell us that the Product is faulty, you agree to keep the Product in its current condition available for us or an agent to inspect within a reasonable time.


You should inform us of any products damaged during delivery within 36 hours of receiving your products. 

In order to provide you with any remedies for a faulty Product, we may need your assistance and prompt provision of certain information regarding the Product, including:

1. you specifying with reasonable detail the way in which it is alleged that the Product is damaged or defective; and

2. you providing us with the delivery note number and such other information as we reasonably require.

If you would like us to repair, replace or provide a refund for the Product where it did conform to the applicable Contract, and we find that the Product has:

1. been misused, abused or subjected to neglect, improper or inadequate care, carelessness, damage or abnormal conditions; or

2. been involved in any accident or damage caused by an incorrect attempt at modification or repair; or

3. been dealt with or used contrary to our or the manufacturer's instructions for the Product; or

  1. deteriorated through normal wear and tear, after delivery by us, we may at our discretion decide not to repair, replace or refund you for the Product and/or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or the payment details that you provided to us when you made your Order, and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.



Our Liability

If We do not deliver or if the Products We deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, our only obligation will be, at our option and within the limits of the law:

1. Make good any shortage or non-delivery or incorrect delivery; or

2. Replace or repair any Products that are damaged or defective; or

3. Refund to you the amount paid by you for the Products in question



We shall have no liability to you for any consequential, special or indirect losses including without limit loss of revenues, profits, contracts, business or anticipated savings damage to or loss of goodwill, reputation or data.

Without prejudice to the foregoing and within the limits of the law, our total aggregate liability to you under and/or arising in relation to this contract shall not exceed the amount paid by you for the Products.

Nothing in this contract shall exclude or limit your statutory rights.

International orders and import duties and taxes



If you order Products from our site for delivery outside Australia, they may be subject to import duties and taxes which are levied when the delivery reaches the destination. You will be responsible for payment of any such import duties and taxes. Please note that We have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Events outside our control – Force Majeure Events:

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event").

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: 17.2.1 Strikes, lock-outs or other industrial action.

Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster

17.2.4 Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

Major limitation of the use of public or private telecommunications networks.

The acts, decrees, legislation, regulations or restrictions of any government.

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

Vouchers and gift cards:

You may use promotional vouchers and gift vouchers as payment for Products on the Site.

We may email gift and promotional vouchers to you. We accept no liability for errors in the email address of the voucher recipient.

If you have a gift or promotional voucher, that voucher can be used by someone other than you and you can assign your rights to use that voucher.

In the event of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with a gift voucher purchase or redemption of that voucher on the Site, we are entitled to close your Account and/or require a different means of payment.

We assume no liability for the loss, theft or illegibility of gift vouchers, promotional vouchers or gift cards.

Conditions for the redemption of promotional vouchers:

From time to time we may release promotional vouchers that may be used on the Site. Promotional vouchers can only be redeemed on the Site.

Promotional vouchers are valid for the specified period stated on them only, can only be redeemed once and cannot be used in conjunction with other offer (including, for the avoidance of doubt, sales, promotions and other vouchers). Individual brands may be excluded from voucher promotions.

The credit of a promotional voucher cannot be used to pay for products from third parties other than us.

If you place an Order for a Product less than the value of the promotional voucher, no refund or residual credit will be returned to you.

The credit of a promotional voucher does not accrue interest nor does it have a cash value.

If the credit of a promotional voucher is insufficient for the Order you wish to make, you may make up the difference through payment by other means (but not by using another promotional voucher or attempting to rely on any other offer).

Please note that only one promotional voucher can be used per order, and that gift vouchers cannot be used in conjunction with any other offer (including but not limited to, sales and other promotions).



Conditions for the redemption of gift vouchers and gift cards:

You may purchase gift vouchers and gift cards for use on the Site by you or other Customers. Gift vouchers will be sent by post and/or email.

Gift vouchers and gift cards cannot be used to buy further gift vouchers or gift cards. Gift vouchers and gift cards may only be purchased through debit or credit card or Paypal.

The credit of a gift voucher or a gift card does not accrue interest nor does it have a cash value.

Note that vouchers and gift cards are applied to invoices as a whole. Accordingly, in circumstances where multiple items are purchased using a voucher or gift card, and one or more items is returned, the discount is applied on a pro-rata basis to each item for the purpose of establishing refund values. For the avoidance of doubt, gift vouchers, promotional vouchers and gift cards cannot, under any circumstances, be redeemed for cash.

Monsterclub



Monsterclub is our loyalty program. When joining monsterclub you acknowledge that you are giving the Company permission to add us to our mailing list. We may send you promotional and advertising material unless you opt out.

As a part of Monsterclub, you may be sent various gifts and vouchers to reward your spending and membership.

The value of the gifts and vouchers may change from time to time at the discretion of the company.

The Company will not hold any liability relating to the Customers expectations of the value of vouchers and gifts they may receive.

The Company reserves the right to suspend the Monsterclub promotion at any time. In this case, any existing vouchers issued will be honoured, but points will no longer be accumulated, and no new vouchers or gifts will be issued.

If we receive an incorrect email address from the Customer and send vouchers, gifts or information to this email address, The company will bear no responsibility for this, and will reissue vouchers, gifts, or information at its own discretion only. Expired vouchers may be forfeit in this case.

The Customer will not hold Monsterthreads in any way liable or responsible for errors in assigning points, rewards, or vouchers as part of the Monsterclub program due to any reason, include incorrect data entry, website errors, database problems etc.

The Customer will not hold Monsterthreads responsible for any loss of data relating to computer errors, database corruption or loss and the such. In these cases Monsterclub data may be lost irretrievably.

The company will do its utmost to back up and protect data to mitigate these types of circumstances.
